A step-by-step practical action plan for U.S. citizens, Green Card holders, and new U.S. residents who currently hold European UCITS funds: establishing residency dates, evaluating filing exceptions, reconstructing trade lots, and remediating prior unfiled years.

1. When Did Your First U.S. Tax Year Begin? Citizenship, Green Card & Substantial Presence

If you recently discovered that your European ETF portfolio (e.g., VWCE, CSPX, VUSA, or bank mutual funds) constitutes a PFIC, the first rule is: do not panic and do not immediately sell your shares. Selling Section 1291 stock triggers an immediate realization event, throwing back all cumulative holding gains across prior tax years.

The starting date of your U.S. tax residency determines when PFIC holding periods begin:

  • U.S. Citizens & Accidental Americans: Subject to worldwide taxation. Many accidental Americans acquired U.S. citizenship at birth even if they never held an SSN or passport; citizenship status and effective dates must be verified before reconstructing PFIC years.
  • Green Card Holders: Worldwide residency start dates depend on when Lawful Permanent Resident (LPR) status was officially granted, U.S. physical presence, and whether the Substantial Presence Test (SPT) applied earlier.
  • Substantial Presence / Visa Holders: Worldwide taxation begins on your residency start date under IRC §7701(b). Prior holding periods while you were a non-resident alien do not create pre-residency U.S. tax liability, but foreign basis rules must be carefully analyzed.

2. Does the $25,000 / $50,000 Form 8621 Exception Apply?

Before preparing complex multi-page filings, evaluate whether you meet the statutory reporting exemption under Treas. Reg. §1.1298-1(c):

  • Aggregate Value Test: The aggregate fair market value of all PFIC stock owned directly or indirectly—including Section 1291 funds, QEFs, and MTM positions—at December 31 must be ≤ $25,000 (single) or ≤ $50,000 (married filing jointly).
  • No Taxable Triggers: You received no excess distributions, sold zero PFIC shares during the year, and have no QEF or MTM elections in effect.

Exceeding the $25,000/$50,000 threshold removes this small-holder reporting exception for Section 1291 funds. Other Form 8621 rules and exceptions must still be evaluated separately for each position.

3. Accumulating ETF, Distribution or Sale: What Happened During the Year?

Review the specific transactions that occurred in your European brokerage account during the tax year:

5. Can You Use §1296 MTM, QEF or Must You Stay Under §1291?

Determine which U.S. taxation regime is legally accessible:

  • QEF Election (§1295): Check whether the fund manager issues a U.S.-compliant PFIC information statement satisfying Treas. Reg. §1.1295-1(g). For European retail UCITS ETFs, this is rarely available.
  • Section 1296 Mark-to-Market: A §1296 election can be made for a later year if the stock remains marketable, but a non-initial election generally triggers §1291 coordination in the transition year.
  • Default Section 1291: Until a valid QEF/MTM election or applicable purging/coordination treatment becomes effective, default §1291 rules continue to apply.

5. How Many UCITS ETF Lots Must Be Reconstructed?

Investors who utilized automated monthly savings plans (ETF-Sparplan in Germany, Austria, or Switzerland) often have dozens of separate purchase lots.

The Reconstruction Workflow:

  1. Every monthly purchase is an independent tax lot with its own acquisition date, euro cost, and EUR/USD exchange rate.
  2. Each lot has its own separate holding period when calculating Section 1291 throwback allocations upon sale.
  3. Tracking multiple lots manually across multi-year holding periods is mathematically complex and error-prone.

6. What Records to Export From IBKR, DEGIRO, Trade Republic or Flatex

Log into your brokerage platform and export the following raw records:

  • Full Account Activity Statements: All trade confirmations from inception to present date in CSV or PDF format.
  • Dividend / Distribution Summaries: Exact dates and euro amounts of all cash distributions received.
  • Year-End Portfolio Statements: December 31 share balances and closing market prices.

7. Missed Form 8621 in Prior Years: What Should You Review?

If you omitted Form 8621 in prior tax years:

  • Statute of Limitations Extension: Under IRC §6501(c)(8), failure to furnish required PFIC information can suspend the statutory assessment limitation period for the tax return until the information is provided. The scope depends on facts and reasonable-cause provisions.
  • Streamlined Procedures: Taxpayers with non-willful omissions can evaluate the IRS Streamlined Foreign Offshore Procedures (SFOP) or Streamlined Domestic Offshore Procedures (SDOP). Note that SFOP offers 0% penalty relief for qualifying expats, while SDOP generally imposes a 5% miscellaneous offshore penalty.
