Frequently Asked Questions: India PFIC & U.S. Cross-Border Taxes
Are Indian mutual funds considered PFICs for U.S. tax purposes?
Indian mutual funds commonly satisfy one or both PFIC tests because their activities and assets are predominantly investment-based. PFIC status is determined under the statutory 75% passive-income or 50% passive-asset tests in IRC §1297.
Are Indian PPF and EPF accounts PFICs?
Not automatically. PFIC rules apply to ownership of stock in a foreign corporation meeting the IRC §1297 tests. PPF and EPF require separate analysis of the legal arrangement, ownership, underlying investments, income recognition, and information-reporting rules. They should not simply be treated as Indian mutual funds. See our Indian PPF & EPF U.S. Tax Guide.
Is an Indian PMS account a PFIC?
The PMS label alone does not determine PFIC status. A separately managed portfolio holding direct shares may contain no PFICs, while a PMS portfolio containing Indian mutual funds, ETFs, AIFs, or other pooled foreign vehicles may create one or multiple PFIC positions. Underlying holdings must be reviewed individually. Read our Indian PMS & U.S. Tax Guide.
Can I make a QEF election for Indian mutual funds?
In almost all cases, no. Indian Asset Management Companies (AMCs like SBI, HDFC, ICICI Prudential) do not calculate or issue PFIC Annual Information Statements (AIS) required under Treas. Reg. §1.1295-1(g). Without an AIS, a QEF election is legally invalid.
Does the $25,000 PFIC exemption apply to Indian mutual funds?
Under Treas. Reg. §1.1298-1(c)(2), if the aggregate value of all PFIC stock is $25,000 or less ($50,000 for married filing jointly) on the last day of the tax year, you are generally exempt from filing Form 8621 Part I, provided you received no excess distributions and recognized zero disposition gains during the year.
How does the IRS tax Indian SIPs (Systematic Investment Plans)?
Each monthly SIP instalment is treated as a separate acquisition lot with its own purchase date, INR/USD exchange rate basis, and holding period under Section 1291. Upon redemption or distribution, throwback calculations must be performed lot-by-lot.
